Quick Summary (Plain Language)

  • We act as a travel agent—we arrange services from airlines, tour operators, cruise lines, hotels, car rental companies, and other third‑party suppliers. Their rules and policies apply in addition to ours.

  • Prices are subject to change until paid in full. Deposits may be non‑refundable.

  • Cancellations/changes often incur fees from both suppliers.

  • Travel insurance is strongly recommended to protect your trip.

  • You’re responsible for passports, visas, vaccinations, and entry requirements.

  • We aren’t liable for acts/omissions of suppliers or events outside our control (e.g., weather, strikes, pandemics).

  • Disputes are handled under Florida law in Broward County, Florida.

  • Please read the full terms before booking.

1) Definitions

  • “Agency,” “we,” “us,” “our”: Travel by Summer Vacations.

  • “Client,” “you,” “your”: The lead traveler and all persons on the same booking.

  • “Supplier(s)”: Airlines, cruise lines, tour operators, hotels, ground operators, insurance providers, car rentals, and any other third parties providing travel services.

2) Our Role as Agent

Travel by Summer Vacations acts solely as an agent for Suppliers. We do not own, operate, or control the services of Suppliers. Your contract is directly with the applicable Supplier(s), whose terms & conditions, waivers, fare rules, and policies (including cancellation/change/refund rules) apply. We are not responsible for Supplier acts, errors, omissions, service quality, schedule changes, insolvency, or their refusal of service.

3) Quotes, Pricing & Inclusions

  • Quotes are estimates only and are subject to availability and change until a reservation is deposited or paid in full and confirmed.

  • Prices generally exclude visas, vaccinations, resort fees, local city taxes, checked baggage fees, seat selection, gratuities, incidentals, and anything not expressly listed as included.

  • Currency fluctuations, tax/fee increases, surcharges, and fuel increases may change your price until paid in full.

  • Obvious errors or omissions in pricing or content are not binding; we may correct them and offer you a refund if you choose not to proceed.

4) Deposits, Payments & Authorization

  • A deposit may be required to secure a booking; deposits are often non‑refundable.

  • Final payment is due by the deadline provided for your itinerary; missed deadlines may result in cancellation with loss of funds.

  • You authorize us to use your payment method to process deposits, final payments, and approved changes in accordance with Supplier rules. Third‑party credit card use may require a signed authorization form and ID.

5) Cancellations, Changes & Refunds

  • All requests to cancel or change must be made in writing to your advisor.

  • Supplier penalties apply to cancellations, amendments, or no‑shows. Many airfare, tour, and cruise fares are non‑refundable and non‑changeable after ticketing.

  • Refunds, if any, are processed according to Supplier policies and timelines.

  • If you cancel after ticketing or final payment, you may receive a future travel credit instead of a cash refund, per Supplier rules. Credits have expiry dates and restrictions.

  • If you purchased travel insurance, claims must be filed directly with the insurer.

6) Travel Insurance (Highly Recommended)

We strongly recommend purchasing comprehensive travel insurance (trip cancellation/interruption, medical, evacuation, baggage, and CFAR—Cancel for Any Reason, where available). Insurance must often be purchased close to initial deposit to cover pre‑existing conditions or for CFAR eligibility. We can provide options and/or referrals, but coverage decisions and claims are between you and the insurer.

7) Client Responsibilities

  • Provide accurate traveler names matching passports, dates of birth, and contact details at the time of booking. Name corrections may not be allowed or may require ticket reissuance with fees.

  • Review all invoices/confirmations and notify us of any discrepancies within 24 hours.

  • Comply with all passport, visa, vaccination, health, customs, and immigration requirements.

  • Arrive at airports/ports/stations by the recommended check‑in times and comply with baggage restrictions.

  • Maintain valid travel documents for the entire trip (passports usually need at least 6 months’ validity beyond your return date).

  • Respect all local laws and customs and Supplier rules.

8) Health, Entry & COVID‑19/Communicable Disease Notices

  • Entry requirements (passports, visas, vaccinations, testing, digital forms, proof of funds/return tickets) vary by destination and may change at short notice. You are responsible for meeting these requirements.

  • Travel may involve health risks. Consult your physician and official government health advisories before travel.

  • You accept the risks related to communicable diseases (including COVID‑19) and understand that additional testing, quarantine, masking, or documentation may be required by authorities or Suppliers and can change unexpectedly. Resulting costs or trip disruptions are your responsibility.

9) Special Requests, Accessibility & Medical Needs

  • Special requests (e.g., bedding, dietary needs, adjacent rooms) are not guaranteed, though we will relay them to Suppliers.

  • If you have mobility, accessibility, or medical needs, please inform us before booking so we can advise on suitability. We cannot guarantee accessibility features unless the Supplier confirms them in writing.

10) Airlines & Flight Issues

  • Airline schedules and aircraft types may change; airlines may cancel, delay, or overbook flights.

  • For missed connections, schedule changes, or irregular operations, the airline controls re-accommodation. We will assist within our business hours as an advocate but have no control over airline decisions.

  • Frequent flyer, seat selection, and baggage benefits are administered by the airline and are not guaranteed.

11) Accommodation & Check‑in

  • Room types, bedding, views, and configurations are subject to hotel availability.

  • Hotels may collect resort fees, city taxes, security deposits, or incidental holds directly from you at check‑in or check‑out.

  • Early check‑in/late check‑out is not guaranteed unless confirmed in writing by the hotel.

12) Car Rentals & Driving

  • Driver’s license, minimum age, credit card, and local law requirements apply. International Driving Permits may be required.

  • Local insurance requirements and deductibles vary; carefully review coverage at pickup.

13) Force Majeure & Events Beyond Our Control

We are not liable for any loss, injury, delay, or expense due to force majeure events including, but not limited to, acts of God, natural disasters, fires, epidemics/pandemics, war, civil unrest, labor strikes, government actions, terrorism, infrastructure failures, or weather. We reserve the right to cancel, postpone, or modify travel arrangements as necessary; refunds or credits will be subject to Supplier policies.

14) Liability Limitation & Indemnification

To the fullest extent permitted by law:

  • Our maximum liability for any claim arising out of your booking is limited to the amount of agency fees you paid to us for the affected services (note: we currently do not charge agency fees).

  • You agree to indemnify and hold harmless Travel by Summer Vacations from claims, damages, losses, costs, and expenses (including reasonable attorneys’ fees) arising from your breach of these Terms, violation of laws, or misuse of travel services.

15) Photos/Testimonials & Marketing Consent

With your consent, we may use your non‑identifying photos, reviews, and testimonials for marketing. You can withdraw consent at any time by contacting us.

16) Privacy

We collect and share necessary personal information with Suppliers to fulfill your booking (e.g., names, DOB, passport details, contact information, payment details, loyalty numbers). We take reasonable steps to protect your information but cannot guarantee absolute security.

17) Fraud, Chargebacks & Dispute Process

  • You agree not to file a chargeback without first giving us and the Supplier a reasonable opportunity to resolve the issue.

  • Unauthorized or fraudulent chargebacks may be referred to collections and may include recovery of fees and costs.

18) Complaints & Escalation

If you experience a problem while traveling, notify the Supplier immediately and contact us as soon as reasonably possible so we can attempt to assist. Failure to promptly report issues may limit our ability to help or your eligibility for adjustments from Suppliers.

19) Governing Law, Venue & Dispute Resolution

These Terms are governed by the laws of the State of Florida, without regard to conflicts of law principles. You agree to exclusive jurisdiction and venue in the courts located in Broward County, Florida.

20) Severability

If any provision is found unenforceable, the remaining provisions remain in full force.

21) Changes to These Terms

We may update these Terms from time to time. The version in effect at the time of your booking confirmation applies to that booking, unless a change is required by law.

22) Entire Agreement

These Terms, together with any invoice/itinerary and Supplier contracts, constitute the entire agreement regarding your booking and supersede prior understandings.

Acceptance

By submitting payment, signing electronically, or otherwise instructing us to proceed with a booking, you acknowledge that you are the lead traveler, have authority to accept on behalf of all travelers on the booking, and agree to these Terms & Conditions and all applicable Supplier terms.
